The Nikah Nama is the document that records a marriage in Pakistan. Far from a formality, it is a contract: the entries made in it carry legal weight, and the clauses it does — or does not — record can matter enormously later.
Dower (haq mehr)
Several columns of the Nikah Nama record dower — its amount, and whether it is prompt (payable on demand) or deferred. Dower is the wife’s right; recording it clearly avoids later disputes about what was agreed.
The delegated right of divorce (Talaq-e-Tafweez)
Column 18 of the Nikah Nama deals with whether the husband delegates the right of divorce to the wife. Where this right is delegated, the wife may herself exercise the right of divorce on the agreed terms.
This entry is often left blank or struck out without thought. Couples should consider it deliberately — it is one of the most significant protections the Nikah Nama can record.
Conditions and other rights
The Nikah Nama can record lawful conditions agreed between the parties — for example regarding maintenance or other matters. Reviewing the document before signing, and completing it accurately, is time well spent.
