Is registering a marriage compulsory in Pakistan?
Yes. The Muslim Family Laws Ordinance 1961 requires every marriage to be registered, and failure to register is a punishable offence. A marriage that is not registered is not for that reason alone invalid, but registration provides essential proof and protects both spouses’ rights.
What is Talaq-e-Tafweez (the delegated right of divorce)?
It is the delegation by the husband to the wife of the right to divorce, which can be recorded in the Nikah Nama (commonly at column 18). Where this right is delegated, the wife may exercise it on the terms agreed. We advise on whether and how to record it.
Can the Nikah Nama include conditions?
Yes. The Nikah Nama records dower and can record lawful conditions — for example regarding the delegated right of divorce, maintenance, or other rights the parties agree. We help ensure any conditions are clearly and validly recorded.
